(Case No. 974/85).
Practice—Recourse under Article 139 and Reference under Article 140 of the Constitution—Not possible for a party other than a party directly involved in proceedings under either Article to take part in any way in such proceedings.
Applications.
Applications by the Cyprus Broadcasting Corporation for leave of the Court to enable the said Corporation to take part in the proceedings instituted by the President of the Republic under Articles 139 and 140 of the Constitution as "an interested party" or as "amicus curiae".
L. Loucaides, Deputy Attorney-General of the Republic with N. Charalambous, Senior Counsel of the Republic, for the respondents.
M. Christophides, for the House of Representatives.
P. Polyviou, for the Cyprus Broadcasting Corporation.
TRIANTAFYLLIDES P. read the following ruling of the Court: The Court has considered identical applications in these three related cases, by counsel appearing for the Cyprus Broadcasting Corporation, for leave enabling the said Corporation to take part in the proceedings either as "an interested party" or as "amicus curiae".
The Court is of the view that on a proper construction of Articles 139 and 140 of the Constitution, and bearing especially in mind the purpose and the nature of the jurisdictions created, respectively, by such Articles, it is not possible for a party other than the parties directly involved in proceedings under either of the said Articles to take part in any way in such proceedings.
We have, therefore, to refuse the aforementioned applications.
Applications refused.
